Terms of Service

The agreement between you and Warisan Nusantara. Please read it.

1. Acceptance of terms

By accessing or using warisannusantara.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service. 2. Eligibility

You must be at least 13 years old (or older if your local jurisdiction requires) to use the Service. If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that entity. We may, at our sole discretion, refuse to provide the Service to any person or entity, and may change eligibility criteria at any time.

3. What we provide

Warisan Nusantara is a heritage-grade travel guide to Indonesia (and other countries we add). We provide: - Free content: Curated content (destinations, dishes, parks, festivals, articles, guides) for personal, non-commercial use - AI trip planner: Generates suggested itineraries based on your preferences - User accounts: Favorites, ratings, reviews, saved trips, custom collections - Newsletter: Weekly travel writing and recommendations - Premium features (Pro and Family): Coming soon, see our [Refund Policy](/refund) and [monetization page](/monetization) - Affiliate booking links: To Booking.com, Agoda, Klook, and other travel partners We do our best to keep content accurate and up to date, but we cannot guarantee 100% accuracy of prices, visa requirements, opening hours, or other time-sensitive information. Always verify before you travel.

4. What you agree to do

As a condition of using the Service, you agree to: - Use the Service for personal, lawful purposes only - Not scrape, republish, or commercially redistribute our content without written permission - Not post reviews or content that is defamatory, hateful, illegal, or infringes on someone else's rights - Not attempt to hack, disrupt, or overload our infrastructure - Not impersonate others or create fake accounts - Not use the Service to spam, phish, or harass anyone - Comply with our [Acceptable Use Policy](/acceptable-use) and [Community Guidelines](/legal/community-guidelines) Reviews and user content must be your own original work. We reserve the right to remove content that violates these terms.

5. Account registration and security

When you create an account, you must provide accurate information and keep it updated. You are responsible for: - Maintaining the security of your account and password - All activity that occurs under your account - Notifying us immediately at [email protected] if you suspect unauthorized access We are not liable for losses caused by unauthorized account access where you failed to secure your credentials.

6. Subscriptions and payments

Some features require a paid subscription ("Pro" or "Family") when launched. The terms: - Pricing is displayed at checkout and may change with 30 days' notice for existing subscribers - Billing is via Stripe; we do not see or store your card details - Auto-renewal continues until you cancel; cancel anytime from account settings - Refunds under our [Refund Policy](/refund) — 7-day guarantee for all subscribers, 14-day EU/UK cooling-off period for EU/UK subscribers - Taxes are added at checkout based on your billing address; we remit VAT/GST as required If you dispute a charge with your bank before contacting us, we may suspend your account while we investigate.

7. Account termination

By you: Delete your account at any time from /account/settings. We honor deletion within 7 days. By us: We may suspend or terminate your account if you violate these Terms or our [Acceptable Use Policy](/acceptable-use). We will give you reasonable notice before termination unless the violation is severe (e.g., illegal activity, security threat, repeated infringement). Effect of termination: Upon termination, your right to use the Service ends. Sections that by their nature should survive (payment obligations, limitation of liability, dispute resolution, intellectual property) will survive.

8. Intellectual property

All content on Warisan Nusantara — articles, guides, photos, code, design, and branding — is owned by us or our licensors, and protected by copyright and trademark law. You may: Read, share (with attribution), and link to our content freely. Use our public RSS feed to follow updates. You may not: Copy our content in bulk, republish it commercially, use our brand or logo to suggest endorsement, or train AI models on our content without written permission. User-generated content (your reviews, photos) remains yours. By posting, you grant us a non-exclusive, worldwide, royalty-free license to display it on the Service. 9. Affiliate links and commercial relationships

Some links on our site are affiliate links. We earn commissions when you book through them, at no extra cost to you. See our [Affiliate Disclosure](/affiliate-disclosure) for full details. We mark affiliate links clearly. Editorial recommendations are independent of affiliate relationships — we recommend destinations and businesses because they are good, not because they pay us.

10. Third-party services

The Service may contain links to third-party websites or services (Booking.com, Agoda, Klook, etc.). We do not control and are not responsible for: - The content, accuracy, or legality of third-party sites - The privacy practices of third-party sites - Transactions between you and third parties - Bookings, cancellations, or refunds handled by travel partners Your use of third-party services is at your own risk and subject to their terms.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that: - The Service will be uninterrupted, secure, or error-free - The results obtained from the Service will be accurate or reliable - The quality of any content, information, or product obtained through the Service will meet your expectations - Any errors in the Service will be corrected Travel content is informational only. We are not a travel agency and do not sell travel services. We are not liable for issues with your travel bookings, accommodations, transportation, or experiences. Always verify travel details with the operator before you travel.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WARISAN NUSANTARA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR: - Any indirect, incidental, special, consequential, or punitive damages - Any loss of profits, revenue, data, use, goodwill, or other intangible losses - Any damages resulting from (a) your access to or use of the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content Whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not we have been informed of the possibility of such damage. In jurisdictions that do not allow the exclusion of certain damages, our liability will be limited to the maximum extent permitted by law. Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) any other liability that cannot be excluded or limited by applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Warisan Nusantara, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: - Your access to or use of the Service - Your violation of these Terms - Your violation of any third-party right, including intellectual property or privacy rights - Any claim that your user content caused damage to a third party

14. Governing law

These Terms are governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions. For consumers in the EU/UK: Nothing in these Terms removes your right to rely on the mandatory consumer protection laws of your country of residence.

15. Dispute resolution

Step 1: Informal resolution. We try to resolve disputes directly. Email [email protected] with a description of the dispute and how you'd like it resolved. We will respond within 30 days. Step 2: Mediation. If informal resolution fails, the parties agree to attempt mediation under the Singapore Mediation Centre (SMC) Rules before commencing arbitration. Step 3: Arbitration. Any unresolved dispute will be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (SIAC) in accordance with the SIAC Rules of Arbitration in force at the time. The seat of arbitration will be Singapore. The tribunal will consist of one arbitrator. The language of the arbitration will be English. The award will be final and binding. Exceptions: Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent or stop infringement of intellectual property or breach of confidentiality. EU/UK consumers: Despite the arbitration clause above, EU/UK consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr and may bring claims in the courts of their country of residence.

16. Class action waiver

To the maximum extent permitted by law, you and Warisan Nusantara agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, then the entire arbitration clause (other than the exception for injunctive relief) will not apply to the dispute, and the dispute will be resolved in court.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be: - Announced on our blog and via email to account holders at least 30 days before they take effect - Indicated by a "Last updated" date at the top Continued use of the Service after changes take effect constitutes acceptance of the new Terms. If you do not accept the new Terms, you must stop using the Service and may close your account for a refund of any prepaid fees.

18. Miscellaneous

Entire agreement: These Terms (including the policies they reference) constitute the entire agreement between you and Warisan Nusantara regarding the Service. Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be struck and the remaining provisions will remain in effect. No waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Assignment: You may not assign these Terms without our written consent. We may assign these Terms to any successor or acquirer of our business. Notices: We may provide notices to you via email, in-app notification, or by posting on the Service. You may provide notices to us at [email protected]. Force majeure: We will not be liable for any failure or delay in performance under these Terms to the extent such failure or delay is caused by events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network or power failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
